Deposit of labelled and related rights

The Law on the Protection of Copyright and Neighboring Rights and its Executive Regulations regulate how to submit applications for depositing labelled and related rights. The Kuwait National Library is working to create special records for requests to deposit labelled and requests for owners of related rights, and how to examine applications and issue certificates of deposit, and the law establishes a grievance mechanism against decisions refusing deposit and registration. Submission of applications for deposit of labelled and related rights

The deposit request shall be submitted by the author of the work or the holder of the related right, as the case may be, or their successors or their legal representatives to the competent department on the form prepared for this purpose. The Regulations of the Law on the Protection of Copyright and Neighboring Rights prohibited that the application include more than one work.

Applications for depositing labelled and related rights are recorded in the filing records, and consecutive numbers are given annually according to the date of their submission.

Examination of applications for deposit of labelled or related rights

The Kuwait National Library examines the deposit request and its attachments. In order to examine the deposit request, the library may seek the assistance of specialists it deems appropriate.

The Director General of the Kuwait National Library issues a decision accepting or rejecting the deposit within a maximum period of sixty days for works and five days for books from the date of submitting the application. The decision to reject the application shall be justified and notified to the student by a letter with acknowledgment of receipt.

Refusal of the application for deposit of labelled or related rights does not preclude the applicant from submitting a new application for deposit, taking into account the avoidance of the reasons for which the previous rejection decision was based.

Acceptance of the application for deposit of the work or related right

In the event that the deposit is accepted, the library shall allocate, according to the type of work or the neighboring right, a number for deposit in the library and an international standard number.

The library prepares a file for each workbook in which it keeps papers, documents, and actions related to the application for depositing the work or related right, and records the actions received.

The regulation of the Law on the Protection of Copyright and Neighboring Rights also required the applicant for the deposit of labelled or related rights whose application was accepted to submit copies of the work or the neighboring right that is the subject of the deposit as indicated in the application form for deposit.

Submit an application for registration of disposal of the right registered in the records of depositing labelled or related rights

The Regulations of the Law on the Protection of Copyright and Neighboring Rights stipulated that a request to record the disposal of the right registered in the depository records should be submitted by the disposer, the disposer, their successors, or their legal representatives to the library on the form prepared for this.

These requests shall be dealt with the same provisions prescribed for requests for depositing a work or related right, and the accepted actions shall be recorded in the records for depositing labelled and related rights, according to the labelled to which these disposals were received.

Issuance of a certificate of deposit of the work

The library issues certificates of deposit at the request of those concerned, and a certificate of deposit of the work is issued in return for a fee of ten dinars for each certificate, with the exception of certificates of deposit issued at the request of government agencies.

Grievance against decisions of refusal to deposit, register and issue certificates

The regulation permits those concerned to appeal against the decisions issued to refuse deposit, registration or issuance of certificates to the competent minister within a period of sixty days from the date of notification of the rejection decision, and the grievance is decided upon within sixty days from the date of its submission.
